These Terms of Service ("Terms") govern your use of the TheraPrac website at theraprac.app and the TheraPrac application ("the App"), operated by Bexland Pty Ltd atf the Donaldson Investment trading as TheraPrac ("we", "us", "our"). By accessing our website or using our App you agree to these Terms. If you do not agree, please do not use our services.

Who We Are

TheraPrac is a practice management app for equine and canine therapy practitioners, developed and operated by Bexland Pty Ltd atf the Donaldson Investment, an ASIC registered Australian business based in Doonan, Noosa Hinterland, Queensland, Australia.

Use of Our Website and App

You may use TheraPrac for lawful purposes only. You agree not to use our website or App to violate any applicable laws or regulations, infringe the rights of any third party, transmit harmful, offensive or misleading content, attempt to gain unauthorised access to our systems, or interfere with the operation of our website or App.

Waitlist Registration

By joining the TheraPrac waitlist you confirm that the information you provide is accurate and complete, you consent to receiving email communications about TheraPrac, and you understand that joining the waitlist does not guarantee access to the App or any specific pricing.

Intellectual Property

All content on theraprac.app including text, images, graphics, logos, and the TheraPrac App itself is owned by or licensed to Bexland Pty Ltd atf the Donaldson Investment. You may not reproduce, distribute, modify or create derivative works from any of our content without our prior written permission.

Your data — including session notes, client records, horse profiles and business information you enter into the App — remains your property at all times.

Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available at theraprac.app/privacy-policy. By using our website or App you consent to our Privacy Policy.

App Availability

TheraPrac is currently in development. We do not guarantee that the App will be available at any particular time, that it will be free from errors or interruptions, or that any features described on our website will be included in the final product. We reserve the right to modify, suspend or discontinue any part of the App at any time.

Founding Practitioner Pricing

Where we offer founding practitioner pricing to waitlist members, the specific terms of that pricing will be communicated to eligible members at the time of launch. We reserve the right to determine eligibility and pricing at our sole discretion.

Limitation of Liability

To the maximum extent permitted by Australian law, Bexland Pty Ltd atf the Donaldson Investment will not be liable for any indirect, incidental, special or consequential damages arising from your use of our website or App, including but not limited to loss of data, loss of revenue or business interruption.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

Third Party Services

Our website and App may integrate with third party services including Google Calendar, Apple Calendar, and payment processors. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of any third party services.

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
